Terms of Service

These Terms of Service are a binding agreement between you (the "Customer", "you") and MONTA CAPITAL INVESTMENT COMPANY LIMITED ("ATGO", "we", "us", "Company"), the legal entity that operates the ATGO Cloud Attendance service at atgo.io.
1. Acceptance of Terms
By accessing or using ATGO Cloud Attendance (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
ATGO is a cloud-hosted attendance management platform operated by MONTA CAPITAL INVESTMENT COMPANY LIMITED. It ingests attendance data from ZKTeco and compatible biometric devices, normalizes it, and exposes a dashboard plus integrations (Odoo HR, etc.) for HR teams. Free and paid plans are offered.
3. Account Registration
You must provide accurate workspace information and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
4. Subscription, Billing & Credits
- Paid plans are billed monthly in USD via Paddle, VNPay (Vietnam), or VietQR bank transfer.
- Payment adds USD credit to your workspace; the system deducts a prorated daily amount (monthly_price / 30) for your active plan.
- When credit reaches zero, the workspace automatically downgrades to the Free plan. Existing attendance data is preserved.
- Pricing may change with 30 days notice via email or in-app banner.
5. Refund Policy
See our Refund Policy: a full refund is available within 14 days of any purchase.
6. Acceptable Use
You agree NOT to:
- Use the Service to violate any law (including data-protection laws).
- Submit or store biometric templates — we strip fingerprint, face, and palm templates from all device payloads before storage.
- Reverse-engineer or attempt to circumvent rate limits, RLS isolation, or device-pairing security.
- Resell the Service without a written reseller agreement.
7. Data Ownership & Privacy
You retain ownership of all employee and attendance data you upload. MONTA CAPITAL INVESTMENT COMPANY LIMITED processes data on your behalf as a processor; see our Privacy Policy.
8. Service Availability
We aim for 99.5% monthly uptime for paid plans. Free-plan SLA is best-effort. Scheduled maintenance windows will be announced at least 48 hours in advance.
9. Disclaimers & Limitation of Liability
The Service is provided "as is". To the maximum extent permitted by law, the aggregate liability of MONTA CAPITAL INVESTMENT COMPANY LIMITED for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Termination
Either party may terminate this agreement at any time. On termination you may export your data for 30 days; thereafter we may delete it.
11. Governing Law
These Terms are governed by the laws of the Socialist Republic of Vietnam. Disputes shall be resolved in the courts of Ho Chi Minh City.
